Okay, that is a very interesting clarification—and a relief for some. Heh—by Assistant Commissioner of Police (Crime) Vincent Wong Fook-chuen. (Full story: here). So that clearly eliminates the possibility of Edison Chen to be prosecuted because he possessed the obscene pictures. Of course, assuming it is really his. Which he surprisingly—or not surprisingly—has so far refused to confirm or deny.
